TERMS OF USE

Welcome to Ascend Me Sports. These Terms of Use govern your access to and use of the Ascend Me Sports website, applications and services. By creating an account or using our services, you agree to these Terms.

1. 1. ELIGIBILITY

   Ascend Me Sports is intended for users age 13 and older.

   By creating an account, you confirm that you are at least 13 years old and that the information you provide is accurate.

   If you are under the age of majority where you live, a parent or legal guardian should review these Terms with you.

2. 2. ATHLETE ACCOUNTS AND PROFILES

   Each athlete account is intended for one athlete profile. You are responsible for maintaining the security of your account and password and for activity that occurs through your account.

   Athletes may update their profile, add new footage and create updated recruiting videos as their game develops.

   Do not impersonate another person or create an athlete profile using false or misleading information.

3. 3. USER CONTENT

   You may upload game footage, training footage, information and other content to Ascend Me Sports.

   You retain ownership of content you upload.

   You confirm that you have the rights and permissions necessary to upload and use that content and that your use of it does not violate the rights of others.

   You give Ascend Me Sports permission to host, store, process, reproduce and modify your uploaded content only as reasonably necessary to operate the service and create the features and recruiting videos you request.

4. 4. RECRUITING VIDEOS

   Ascend Me Sports provides tools that help athletes organize their information and footage into recruiting videos.

   Athletes are responsible for reviewing their information and finished videos for accuracy before sharing them.

   Finished recruiting videos may be downloaded and shared outside Ascend Me Sports. Once content is downloaded or shared outside our services, Ascend Me Sports cannot control how third parties may use, copy or redistribute it.

   Ascend Me Sports does not guarantee that creating or sharing a recruiting video will result in recruitment, team placement, scholarships, offers, tryouts or other opportunities.

5. 5. ACCEPTABLE USE

   You agree not to use Ascend Me Sports to:

   • Upload content you do not have permission to use
   • Upload unlawful, abusive, threatening, harmful or inappropriate content
   • Misrepresent an athlete's identity, qualifications or information
   • Attempt to interfere with the security or operation of our services
   • Access another user's account without permission
   • Use the service for unlawful or fraudulent purposes

   We may remove content or restrict access when reasonably necessary to protect users, the service or others.

6. 6. ASCEND ME SPORTS OWNERSHIP

   Ascend Me Sports and its branding, website, application, design, software, features and other materials provided by us are owned by Ascend Me Sports or its licensors and are protected by applicable intellectual property laws.

   These Terms do not transfer ownership of Ascend Me Sports intellectual property to users.

7. 7. FEES, SUBSCRIPTIONS AND PAYMENTS

   Ascend Me Sports offers an annual membership for one athlete. A membership may be used by that athlete to create recruiting videos for multiple sports.

   The annual membership price is $49.99 USD per year in the United States. Prices may vary by country or storefront, and the applicable price will be displayed before purchase.

   Memberships purchased through the Ascend Me Sports mobile application are billed through the applicable Apple App Store or Google Play account. The membership automatically renews annually unless cancelled in accordance with the applicable app store’s subscription terms.

   Users may manage or cancel their subscription through the Apple App Store or Google Play, as applicable. Cancelling automatic renewal generally allows membership benefits to continue through the remainder of the already-paid subscription period, subject to applicable app store policies and law.

   An active membership allows an athlete to create and download clean recruiting videos without the preview watermark and to update recruiting videos throughout the membership period.

   If a membership expires or is not renewed, the athlete may retain access to their account and existing completed recruiting videos, but an active membership is required to generate new clean recruiting videos.

   Payments, renewals, cancellations and refunds are also subject to the terms and policies of the applicable app store and applicable law.

8. 8. SERVICE AVAILABILITY AND CHANGES

   We may update, improve, modify or discontinue features of Ascend Me Sports over time.

   We do not guarantee that the service will always be available without interruption or error. Maintenance, technical issues or circumstances outside our control may occasionally affect availability.

   Features described as future or upcoming are not guaranteed to be released on a particular date.

9. 9. ACCOUNT SUSPENSION OR TERMINATION

   We may suspend or terminate access to Ascend Me Sports when reasonably necessary because of a violation of these Terms, unlawful activity, security concerns, misuse of the service or risks to other users.

   Users may stop using Ascend Me Sports at any time and may request account deletion.

10. 10. PRIVACY

    Our collection and use of personal information is described in the Ascend Me Sports Privacy Policy. Please review the Privacy Policy for more information.

11. 11. DISCLAIMER AND LIMITATION OF LIABILITY

    Ascend Me Sports is provided on an “as available” basis. To the extent permitted by applicable law, we do not guarantee that the service will always be uninterrupted, error-free or suitable for every user's particular purpose.

    To the extent permitted by applicable law, Ascend Me Sports will not be liable for indirect, incidental or consequential losses arising from use of the service.

    Nothing in these Terms excludes rights or remedies that cannot legally be excluded under applicable law.

12. 12. GOVERNING LAW

    These Terms are governed by the laws applicable in Ontario, Canada, without limiting any mandatory consumer rights that may apply where you live.

13. 13. CHANGES AND CONTACT

    We may update these Terms as Ascend Me Sports develops or legal requirements change. The “Last Updated” date will reflect changes.
